The employee was wearing a safety harness, but was not attached to the boom or basket. The employee stood on building material to increase the work height above the safety of the lift's guardrail system; on, or about, 05/09/2014. The employee was not protected from falling; on, or about, 05/20/2014 FM Home Improvement, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 959780, citation number 1, item number 1 and was affirmed as a final order on 04/01/2014, with respect to a workplace located at 11 East Dewey Ave., Wharton, NJ 07885. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
