OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a.  On or about May 23, 2014, at the job site located at 66800 Executive Drive, St. Clairsville, Ohio, an employee was observed working from a wooden pallet (approximately 54 inches wide by approximately 106 inches long) on the forks of a JLG rough terrain forklift, model G6-42A, serial # 0160026077, elevated to a height of approximately 15 feet above the ground level below.  The employee was not utilizing personal fall protection, exposing the employee to the hazard of a fall from elevation.

29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.  a.  At the construction site located at 66800 Executive Drive, St. Clairsville, Ohio, employees used a power operated Dewalt angle grinder, Model D28402, without the guard in place, thereby exposing employees to a struck-by hazard.
