29 CFR 1926.20(b)(2):  Employer did not provide programs for frequent and regular inspections of the job sites, materials, and equipment to be made by a competent person designated by the employers:              (a)Escarzaga Roofing @ 7500 East Quincy, Denver, CO:  On and before May 28th, 2014, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include frequent and regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees on-site were working on a 5/12 pitch roof without Personal Fall Arrest Systems (PFAS) to minimize falling. The condition exposed employees to a fall hazard of approximately 25 feet.       Abatement Note: OSHA defines a competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.

29 CFR 1910.178(l)(1)(i): The employer did not ensure each powered industrial truck operator was competent to operate a powered industrial truck safely as demonstrated by the successful completion of all training and evaluation specified in this paragraph (l).    (a)  Escarzaga Roofing @ 7500 East Quincy, Denver, CO: On and before May 28th, 2014, as part of the injury/accident prevention responsibilities, the employer did not ensure each employee who was allowed to operate the All-Terrain Forklift (JLG Skytrak) was trained in the safe operation as required by the standard.       Abatement Note: 29 CFR 1926.602(d): Powered industrial truck operator training. The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter.    Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe-boards, safety net systems, or personal fall arrest systems:     (a)Escarzaga Roofing @ 7500 East Quincy, Denver, CO: On and before May 28th, 2014, the exposing employer did not ensure the use of appropriate fall protection for employees tearing off roofing shingles from a 3 story, 5 in 12 pitched roof.  The condition exposed employees to a fall hazard of approximately 25 feet.     Escarzaga Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard CFR 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 313714545, citation number 2, item number 1, issued on October 20, 2009, and became final order on November 4th, 2009, with respect to a workplace located at 18139 E. Main Street, Parker, CO.
