OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by traffic hazards. On or about 05/28/2014, on Mill Street/Route 616, Vincentown NJ, one company employee was observed acting in the capacity of flagger and laborer while another employee was performing pump maintenance work requiring the employee to reach into the manhole (to remove the pump) as well as perform maintenance to it from outside of the manhole. This operation was occurring in the center lane of the active roadway. The single flagger was redirecting traffic from around the parked company vehicle by jumping between the lanes. CSHO observed and determined that following conditions existed at the worksite: a) Employees were not trained on the appropriate flagger procedures. b) Employees were not provided with the appropriate STOP/SLOW paddles as a warning to oncoming vehicles. c) Employees were flagging from unsafe locations within the traveled lanes of the roadway. d) Flaggers and flagging stations were located too close to the activity area. e) No advance warning signs were posted to warn motorists of the flaggers and/or the activity in the roadway. f) No competent person at worksite to perform frequent and regular inspections to identify unsafe conditions and acts. This person would have the training and authority to stop unsafe work/acts and correct them. g) Employees were not provided with reflective vests so that traffic, travelling in the travelled way, would be alerted to their presence/work activities. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.

A written certification was not made available to each employee who entered the space. Condition existed on or about 05/28/14.
