29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment was not completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned were appropriate for that operation and worked properly:    a)  On or about June 25, 2014, and at times prior, employees were exposed to unknown quantities of airborne asbestos fibers while removing asbestos containing materials including floor tile and mastic because the employer failed to complete an initial exposure assessment in a timely manner.  Personal air samples were collected but had still not been sent for lab analysis about six days after the removal began.

29 CFR 1926.1101(k)(8)(i): Labels were not affixed to all products containing asbestos and to all containers containing such products, including waste containers:  a)  On or about June 25, 2014, the employer failed to ensure that the waste dumpster used to collect asbestos waste (floor tile and mastic) was labeled to indicate the presence and hazards of asbestos.  Without such a label, employees working in the area could accidentally use the dumpster for other things and possibly be exposed to asbestos in the process.

29 CFR 1910.134(m)(2)(i)(C): The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the specific make, model, style and size of respirator tested:  a)  On or about June 25, 2014, and at times prior, employees were potentially exposed to asbestos because the employer had not included the make, model and size of respirator on some of the fit tests given to employees.  Without such information, it was uncertain if the half face respirators they used were the type they were tested for and were properly fit.
