29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) On or about June 07, 2014, and  at prior times, at the Shell Oil products facility in Deer park Texas, the employer failed to ensure that protective equipment, such as protective shields or barriers and/or thermal protective clothing, were used when an employee opened process equipment operating at 650-700 degree F.    b) On or about June 07, 2014, the employer failed to ensure that an employee wore appropriate face and eye protection while opening process equipment operating at 650 to 700 degree F.

29 CFR 1910.147(d)(5)(i): Following the application of lockout or tagout devices to energy isolating devices, all potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe:    On or about June 07, 2014, and at prior times, at the Shell Oil products facility in Deer park Texas, the employer did not ensure that all stored or residual energy was relieved, restrained or rendered safe prior to performing maintenance work or instrument taps and process flow transmitters.

29 CFR 1910.119(m)(3): An incident investigation team shall be established and consist of at least one person knowledgeable in the process involved, including a contract employee if the incident involved work of the contractor, and other persons with appropriate knowledge and experience to thoroughly investigate and analyze the incident:    On or about June 07, 2014, and times thereafter, at the Shell Oil products facility in Deer Park, Texas, the employer failed to establish an incident investigation team that consisted of a contract employee when the incident involved the work of the contractor.
