29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) Throughout facility - The employer failed to assess the working areas to determine the presence of any hazards when employees were utilizing grinders, drills, saws and spray machines and using chemicals such as Minspar 200, Kaolin Slurry, and Ball Clay Slurry with ingredients such as Crystalline Silica and Aluminum Silicate. Employees were exposed to eye, skin and respiratory tract irritations.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: a) In Spray department - Employer permitted half face respirators to be used by employees when using spray machines who had facial hair that comes between the seal, causing respirator to not fit the employee's face properly. Employees were exposed to upper respiratory tract irritation.

29 CFR 1910.1000(c): An employee was exposed to Crystalline Silica in excess of the 8-hour time weighted average limits of 1.136 M listed in Table Z-3: a) In Kiln Wash department An employee working in vicinity of Kiln Wash was exposed to airborne Crystalline Silica at an 8-hour time weighted average (TWA) of 3.05 milligrams per cubic meter (mg/m3), which is 3.03 times the permissible exposure limit (PEL) of 1.136 mg/m3. The exposure level was derived from a sample collected over a 430 minute sampling period on July 29, 2014. Zero exposure assumed for the minutes not sampled. Employees were exposed to lung injury, cancer and Silicosis

29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings: a) In Kiln Wash department - The employer did not provide any labels for information regarding the hazards of chemicals when employees were working with the containers of Kiln Wash solution that contained chemicals such as KT-Cast ( Kaolin Clay), Aluminum Trihydrate and FD&C Blue No Powder with ingredients such as Kaolin and Crystalline Silica. Employees were exposed to eye and skin irritations and fire hazards.
