OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to using a job trailer that had not been leveled and anchored to prevent displacement. (a) Blanton Construction on or about August 6, 2014 had a mobile job trailer that had not been leveled and anchored to prevent displacement of the trailer.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: (a) Blanton Construction on or about August 6, 2014 had workers exposed to fall hazards of approximately 18 feet from an open sided floor. The opening had been present and the workers had been exposed for approximately 3 weeks and the competent person for Blanton Construction had not inspected the job site and addressed the fall hazard. (b) Blanton Construction on or about August 6, 2014 had a job trailer that was unsafe to enter, to work in, and exit and the competent person for Blanton Construction had not inspected the job site and addressed the hazards which included stairs missing hand rails, stairs outside of a door with no landing, a trailer that had not been leveled and anchored, and the obstructions in front of the steps affecting emergency egress. (c) Blanton Construction on or about August 6, 2014 had workers using both extension ladders and step ladders. Three ladders could be seen just approaching the site, and none of the three were set up in a safe manner and being used in a safe manner. A step ladder was leaned against the building and was 3 feet shorter than the landing it was being used to egress. Two extension ladders, one on the north side and one on the south side of the building and neither one extended 3 feet above the landing point for which it was being used.

The door swung outwards over the stairs and there was not a platform at the top of the stairs that extended at least 20 inches (51 cm) beyond the outward swing of the door.

29 CFR 1926.1053(b)(1): Where portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) Blanton Construction on or about August 6, 2014 allowed a roofing contractor to use an extension ladder that did not reach 3 feet above the parapet wall. The ladder located on the south side of the building under construction was not anchored to prevent displacement and grasping devices were not provided to assist employees in mounting and dismounting the ladder. (b) Blanton Construction on or about August 6, 2014 allowed other trades than the roofing contractor to use an extension ladder that did not reach 3 feet above the parapet wall. The ladder located on the north side of the building under construction was not anchored to prevent displacement and grasping devices were not provided to assist employees in mounting and dismounting the ladder. (c) Blanton Construction on or about August 6, 2014 allowed a 10 foot step ladder leaning against the wall to be used to egress a landing that was 13 feet above the same surface the 10 foot step ladder was resting on. The sides of the step ladder did not extend 3 feet above the landing point. Other safe means to reach the surface had not been provided, and the worker using the ladder stepped on the top step and the top of the step ladder to reach the landing.
