OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to entrapment and crushing hazard caused by mechanical failure of the vehicle's braking system:   On or about 8/11/14 at 4789 Rollins Road in Augusta, GA: Waste Collection Drivers and Assistant Drivers operated vehicles with a faulty service brake system, which caused one employee to be fatality injured when the service brakes failed. The employer failed to ensure the vehicle being operated by the employees was in safe working condition.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).   On or about 8/12/14 at 3925 Goshen Industrial Blvd, Augusta, GA: Employees were exposed to chemical hazards to their arms, hands, face, and eyes while handling the chemicals such as but not limited to Natural gas, Antifreeze (ethylene glycol) , and Engine Oil, during pre and post trip inspection. The employer failed to assess the workplace and provide personal protective equipment to the exposed employees.
