29 CFR 1926.501(b)(15):  Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:   (a)   On or about October 15, 2014, for an employee exposed to fall hazards of approximately nine feet while sheathing the exterior of a garage unit while standing on a roof truss for an apartment complex near Veterans Boulevard South and 40th Street, Fargo, North Dakota.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:   (a) On or about October 15, 2014, for employees exposed to fall hazards of approximately nine feet while standing within the roof trusses to install wall sheathing where an employee was provided a harness and lanyard that was inappropriate for the task with no effective means of anchorage near Veterans Boulevard South and 40th Street, Fargo, North Dakota.
