OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:  a. On or about October 29, 2014 west the east side of the structure, an employee used a wooden job made ladder without filler blocks inserted between the rungs to support the cleats, exposing himself to a 9-foot 5-inch fall hazard.   Among other methods, one feasible and acceptable method to correct this hazard is to, but not limited to the following: (1) conform to the American National Standard Institute (ANSI) A14.4-1992, section 4.5.2.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. On or about October 29, 2014, an employee used a wooden ladder to access a structure improperly, in that the ladder did not extend 3 feet over the edge nor was secured from slippage, exposing the employee to a fall hazard.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a. On or about October 29, 2014, two employees performing framing operations were not wearing protective helmets, exposing themselves to overhead hazards.    The DWC Contracting, Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 951010, citation number 01, item number 001 and was affirmed as a final order on January 8, 2013, with respect to a workplace located at SW 80 Place, Gainesville, Florida 32608.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about October 29, 2014, on top of a structure, an employee performing framing operations was not protected from a 9-foot 5-inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternative fall protection.  The DWC Contracting, Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 951010, citation number 01, item number 003 and was affirmed as a final order on January 8, 2013, with respect to a workplace located at SW 80 Place, Gainesville, Florida 32608.
