29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    The employer did not provide training and/or a performance evaluation (driving test) at least once every three years for every employee authorized to operate the powered industrial truck in the facility.  The employer accepted prior employer training for authorized operators, but did not verify competency with performance evaluations, which exposed employees to struck-by hazards.    There is no abatement certification or documentation required for this item.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.     The guards on the following machines did not prevent access to the point of operation during operating cycles, exposing employees to amputation and laceration hazards:      (a) Okuma MX-45VAW CNC Mill.  The machine continued running when the door was opened during operation.  Movable door interlock(s) were not functional.     (b) Okuma LB25II CNC Lathe.  The machine continued running when the door was opened during operation.  The movable door interlock(s) were not affixed to the machine and were sitting on top of the machine.        (c) Okuma LB25 CNC Lathe.  The machine continued running when the door was opened during operation.  The movable door interlock(s) were not functional.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200 for labels and other forms of warning, safety data sheets and employee training and information would be met.  The employer maintained some safety data sheets for chemicals used but did not develop a written hazard communication program or provide training to employees on the hazards of the chemicals.  Employees were exposed to chemical hazards such as skin irritants and combustible liquids.    There is no abatement certification or documentation required for this item.
