29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. On 11/12/2014, the owner and two employees from Kurtley Construction were working on the roof of a commercial building located at 11008 Schreckengast Road, Hickory Grove MO. They were working without the use of guardrail systems, safety net systems, or personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. On 11/12/2014, the owner and two employees from Kurtley Construction were repairing a roof of a commercial building located at 11008 Schreckengast Road, Hickory Grove MO. They were using a ladder improperly. The ladder was not extended three feet beyond the landing or edge of the roof.
