29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) At the facility, where the employer had not implemented a hearing conservation program. An employee polishing stainless pieces was exposed to 67.2% of the noise dose which is equivalent to approximately 87.1 dBA. Sampling was conducted for 404 minutes during one shift on December 23, 2014. Zero exposure was assumed for the unsampled time of 76 minutes.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by rotating parts, ingoing nip points, and/or point of operation hazards: a) In the Machine Shop, where the chuck on the Victor high precision lathe was not guarded which exposed employees to rotating parts. b) In the Fabrication Area, where the Chicago press brake, model HPB6026, serial 330271 was not guarded which exposed employees to ingoing nip points and point of operation hazards.
