OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling or collapsing wood trusses: Foxland Harvestore, Inc., at the site located at N8341 Dairyland Rd. Sheboygan, WI.: On and about 12/17/14, employees erecting the roof truss system on a barn were exposed to falls and crushing hazards while working on and under trusses that had not been braced to resist rolling over or collapsing due to the lack of top chord diagonal bracing and the lack of bottom chord and web member lateral and diagonal bracing.

As referenced by; 29 CFR 1910.178(l)(3)(i)(M): Powered industrial truck operators shall receive initial training in the following topics to include but not limited to operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate: Construction reference: 1926.602(d): On or about 12/17/14, the employees operating and working near a rough terrain forklift had not been trained to recognize and follow specific procedures contained in the operator's manual which was demonstrated by the JCB rough terrain forklift being left unattended with an elevated load on a downward slope to the building when the wheels were not chocked to prevent movement and the area below the load and boom was not marked to prevent anyone from passing below the elevated load.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On 12/17/14, employees installing purlins on wood trusses forming the roof of a barn were not protected from falling with complete personal fall arrest systems. Foxland Harvestore was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 984338, citation number 1, item number 2, and was affirmed as a final order on 8/6/14, with respect to a workplace located at N8341 Dairyland Rd. Sheboygan, WI 53083.
