29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   a) On or about 12/18/14, at 41-43 21st Street. Long Island City, NY  Employer issued half face dual cartridge negative pressure respirator to employees to be used for spray in the building. The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee is required to wear respirator.  ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1910.134(f)(2): The employer did not ensure that each employee using a tight fitting face piece respirator was fit test prior to initial use of the respirator, whenever a different respirator face piece (size, model or make) is used and at least annually thereafter and after each use:  a) On or about 12/18/14, at 41-43 21st Street. Long Island City, NY  Employer issued half face dual cartridge negative pressure respirators to employees to be used for spray inside the building. The employer did not ensure each employee using a tight-fitting face piece respirator was fit tested prior to initial use of the respirator.  ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
