29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) WMG Historic Restoration, work area: The employer did not establish and implement the elements of a written program to ensure employees voluntarily using half face elastomeric respirators such as 3M6200 acid-gas chemical cartridge and P100 filters, 3M 4112 with P100 filters, etc were medically able to use that respirator and the respirator was cleaned, stored and maintained so its use did not present a health hazard.  Condition noted on or about 2/2/15.

The employer did not ensure that employees could demonstrate knowledge as required in (k)(1)(i) - (k)(1)(vii).  Condition noted on or about February 2, 2015.

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:    a) WMG Historic Restoration LLC. - An initial determination was not made to determine if employees were exposed to lead at or above the action level of 30 micrograms per cubic meter. An employee conducting window refinishing and restoration was exposed to an 8-hour TWA of 47.6 ug/m3 of lead during a 386 minute occupational exposure.  The 8-hour TWA employee exposure was 1.59 times the OSHA Action Level.  Violation occurred on or about February 2, 2015.

29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:    a) WMG Historic Restoration LLC (Employee Break Room) - Employees were exposed to dust containing lead which was present on surfaces.  Wipe samples taken from break room table ranged from twenty-six (26) to one hundred ninety (190) micrograms of lead in one hundred (100) square centimeter area.  Condition noted on or about 2/2/15.

29 CFR 1910.1025(l)(1)(ii): The employer did not train each employee who is subject to exposure to lead at or above the action level, or for whom the possibility of skin or eye irritation exists, in accordance with the requirements of 29 CFR 1910.1025:    a)  WMG Historic Restoration, Philadelphia, PA (work shop):   Employees engaged in historic restoration of window frames coated with lead paint were exposed to lead above the action level and were not provided training in accordance with the requirements of 29 CFR 1910.1025.  Employee exposure monitoring revealed an 8-hour TWA exposure of 47.6 microgram per ug/m3 of lead during a 386 minute occupational exposure, which was 1.59 times the OSHA Action Level of 30 ug/m3.  Violation occurred on 2/2/2015.
