29 CFR 1910.95(c)(1): The employer must administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures must be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment.    On March 4, 2015, the employees were exposed to noise hazards when the employer failed to implement a continuing and effective hearing conservation program. The employer failed to provide a safe and healthy work environment free of hazards associated with noise levels:    (a)    A production employee was exposed to continuous noise levels at 55% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 86 dBA. The sampling was performed for 483 minutes during one shift; the action level was calculated based on a 12 hour shift at 82.1 dBA.  (b)    A production employee was exposed to continuous noise levels at 77% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 88 dBA. The sampling was performed for 482 minutes during one shift; the action level was calculated based on a 12 hour shift at 82.1 dBA.  (c)    A production employee was exposed to continuous noise levels at 70% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 87 dBA. The sampling was performed for 480 minutes during one shift; the action level was calculated based on a 12 hour shift at 82.1 dBA.  (d)    A production employee was exposed to continuous noise levels at 86% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 89 dBA. The sampling was performed for 476 minutes during one shift; the action level was calculated based on a 12 hour shift at 82.1 dBA.

29 CFR 1910.95(d)(3): Monitoring must be repeated whenever a change in production, process, equipment or controls increases noise exposures to the extent that:    On March 4, 2015: The employer failed to conduct additional noise monitoring after plastic shakers were replaced by metal shakers on the production floor, resulting in increasing noise levels. Employees were exposed to noise hazards.    (a) An employee on the production floor was exposed to continuous noise levels at 55% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 86 dBA. The sampling was performed for 483 minutes during one shift on March 4, 2015; the action level was calculated based on a 12 hour shift at 82.1 dBA.  (b) An employee on the production floor was exposed to continuous noise levels at 77% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 88 dBA.
