29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres or other hazardous conditions: a) Excavation: A competent person was not on site to make inspections as needed throughout the shift, on or about 2/14/15 Abatement note: To be "a competent person" under this standard, a person must have training in and be knowledgeable about, soils analysis, the use of protective systems and the requirements of this standard. Competent person means one who is capable of identifying existing and predictable hazards in the surroundings, or working conditions which are unsanitary, or dangerous to employees....
