29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) Excavation - Forms perpendicular to Main St: Employees without any means of fall protection were exposed to a fall of approximately 13  feet while engaged in concrete form removal activities, on or about 2/14/15.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres or other hazardous conditions:    a) Excavation: A competent person was not on site to make inspections as needed throughout the shift, on or about 2/14/15   Abatement note: To be "a competent person" under this standard, a person must have training in and be knowledgeable about, soils analysis, the use of protective systems and the requirements of this standard. Competent person means one who is capable of identifying existing and predictable hazards in the surroundings, or working conditions which are unsanitary, or dangerous to employees....

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was more than 5 feet deep:  a) Excavation: Employees  while inside at the bottom of an unprotected excavation, approximately 9 feet in depth, were exposed to a cave in hazard, on or about 2/14/15.
