OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling or collapsing wood trusses:    Lorbiecki Builders LLC, at the site located at 6521 Kurey Dr., Appleton, WI: On and about 3/13/15, employees erecting the roof truss system on a single story house were exposed to falls and crushing hazards while working on and under trusses that had not been braced to resist rolling over or collapsing due to incomplete top chord lateral bracing, the lack of adequate top chord diagonal bracing and the lack of bottom chord and web member lateral and diagonal bracing. Employees were also exposed to struck by hazards from falling trusses that were being lifted with a chain sling rigged to a single point on the trusses.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:    On and before 3/13/15, Lorbiecki Builders did not implement or communicate safety programs which would inform employees to recognize, avoid or prevent common hazards relating to residential construction, to include:    a) Safe and effective methods to handle and install wood truss systems;     b) The proper use of PPE to include eye and head protection;    c) Effective methods of fall protection;    d) and the proper selection and use of portable ladders.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:    On and before 3/13/15, employees had not been trained to select and properly use ladders which exposed them to fall hazards while performing residential construction activities in that:    a) Ladders did not extend at least 3' above the upper landing surface;    b) The top step and head of the step ladders were used while climbing up and down from the trusses;    c) Step ladders were used when leaning against the sides of the house while installing house wrap.
