Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the backhoe's bucket: a) Near the shore side south end of the project, a bent nail and piece of rebar were substituted for manufacturer's retaining pins or equivalent to secure a bucket pivot pin that held the bucket on a John Deere backhoe, ID 70910DA780248, exposing employees to the hazard of being struck by the bucket in the event the bucket separated from the backhoe boom. b) Near the middle of the project, a bent 0.5 inch diameter rebar through a pivot pin hole and a piece of round stock welded onto the ends of pivot pins were substituted for the manufacturer's retaining pins or equivalent to secure a bucket on an EL200B Caterpillar excavator, PIN: 5EG00385, serial number 004765. Employees were exposed to the hazard of being struck by the bucket in the event the bucket separated from the excavator.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: Near the shore side south end of the project, the seat belt was not worn while moving a John Deere backhoe, ID 70910DA780248, over rough and uneven terrain. The male side of the seat belt was wrapped a few times around a support for the seat back so it could not be connected to the female side of the seat belt. Employees were exposed to the hazard of being struck by the backhoe in the event of rollover or striking against other surfaces in the event of falling out of the backhoe.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects were not corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment is necessary: Near the middle of the project, the front tire sidewalls were cracked and broken off down to the belts on a John Deere backhoe, ID 7091SDA780248. The backhoe was used to help set fence posts. Employees were exposed to the hazard of being struck by the backhoe.

29 CFR 1926.604(a)(2): All equipment used in site clearing operations was not equipped with rollover guards meeting the requirements of this subpart: Near the center of the project, the EL200B Caterpillar excavator, PIN: 5EG00385, serial number 004765, used to clear ironwood trees and undergrowth from the site, was not equipped with rollover guards. According to the manufacturer, the excavator was made in Japan on March 24, 1989, it did not have roll over protection, and Caterpillar did not have roll over protection available on excavators until March 2010. Employees were exposed to the hazard of being struck by the excavator in the event of rollover.
