29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: In the parking lot at the back of the building, there were no ground fault circuit interrupters or assured equipment grounding conductor program to protect employees that used 110 VAC concrete mixer. No identification plate was visible. Employees that used the concrete mixer to mix water with cement were exposed to the hazards of contacting electricity.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, and enclosures was not permanent and continuous: (a.) In the parking lot at the back of the building, there was no grounding continuity between the grounding pin on the plug of a flexible cord and the grounding screw in the control box for a 110 VAC concrete mixer. No identification plate was visible. Employees that used the concrete mixer to mix water with cement were exposed to the hazards of contacting electricity. (b.) In the parking lot at the back of the building, there was no grounding pin on the extension cord that provided power to a 110 VAC concrete mixer. No identification plate was visible. Employees that used the walkway to access the second level interior were exposed to the hazard of falling from a height of about 11 feet to the concrete below.

There were 8 risers to a 5.5 foot high landing and 8 risers to the 11 foot high second level. Employees were exposed to the hazard of falling from heights that varied up to 11 feet to the concrete below.

The landing was 10 feet long by 5 feet wide. Employees were exposed to the hazard of falling from a height of about 5.5 feet to the concrete below.
