29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) WGN Continental Broadcasting Company, LLC dba WGN Television, Chicago, IL, did not develop or implement a complete and effective written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were exposed to hazardous chemicals in the garage or stored in the flammable liquid storage cabinets located in the garage, which included carbon monoxide, Splash Windshield Washer Fluid (contains 22% methanol and less than 1% ethylene glycol monobutyl ether); CAM2 Super HD premium 15W40 motor oil (contains heavy paraffinic and petroleum distillates).   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) WGN Continental Broadcasting Company, LLC dba WGN Television, Chicago, IL, did not provide information and training on the chemicals that WGN employees used or were exposed to in the garage including, carbon monoxide, Splash Windshield Washer Fluid (contains 22% methanol and less than 1% ethylene glycol monobutyl ether); CAM2 Super HD premium 15W40 motor oil (contains heavy paraffinic and petroleum distillates.  b) WGN Continental Broadcasting Company, LLC dba WGN Television, Chicago, IL, did not provide employees the required training on the revised elements of the Hazard Communication Standard for labels (e.g., pictograms and signal words) and the new format of the Safety Data Sheet (SDS) (i.e., section changes & section order and types of information contained within each section of the SDS), which was due December 1, 2013.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
