29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   On or about April 22, 2015 the employer did not ensure that each powered industrial truck operator was trained and certified to operate a powered industrial truck, exposing employees to the hazards associated with operating a forklift.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On April 22, 2015 employees were not protected from a 13.3 foot fall while performing work activities on the second floor of a commercial building and the employer did not ensure employees were utilizing fall protection.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:   On April 22, 2015 employees were exposed to impalement hazards associated with working around protruding, unguarded reinforcing steel and the employer did not ensure that all reinforcing steel was guarded.   No abatement certification is required of this item.
