29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about April 22, 2015 the employer did not ensure that each powered industrial truck operator was trained and certified to operate a powered industrial truck, exposing employees to the hazards associated with operating a forklift. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On April 22, 2015 employees were not protected from a 13.3 foot fall while performing work activities on the second floor of a commercial building and the employer did not ensure employees were utilizing fall protection. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
