OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  Shipping Gallery:  On or about April 23, 2015 and times prior thereto, an employee accessed a hatch to gain access to a lower level and was not wearing a fall protection harness.  This exposed employee to over a 50 foot fall to the lower level.  Shipping Gallery:  On or about April 23, 2015 and times prior thereto, an employee did not know how to properly wear his fall protection equipment.  He had the lanyard attached improperly and was not certain at what to tie off to.  This exposed employee to a potential fall hazard over 50 feet to the lower level.

29 CFR 1917.112(b)(1): Guardrails were not provided at locations where employees were exposed to floor or wall openings or waterside edges, including bridges or gangway-like structures leading to pilings or vessel mooring or berthing installations, which presented a hazard of falling more than 4 feet or into the water.  (a)  Rail Car Shed:  On or about April 23, 2015 and times prior thereto, a platform 15 feet in height that employees could access was not guarded by railings.  This exposed employees to potential fall hazard of 15 feet to the lower level.  (b)  Shipping Gallery:  On or about April 23, 2015 and times prior thereto:  A hatchway was opened and did not have proper guarding to protect employees.  This exposed employees to a 10 foot fall to the level below.

29 CFR 1917.112(c)(3): The top surface of guardrails installed after October 3, 1983, was not 42 inches, plus or minus 2 inches high.  (a)  Top of Grain Bins:  On or about April 23, 2015 and times prior thereto, the employer had two chains for a railing with the top rail under 36 inches with over 8 inches of up and down play.  This exposed employees to over a 50 foot fall to the lower level.  (b)  South Crane :  On or about April 23, 2015 and times prior thereto, the employer had two chains for a railing with the top rail under 36 inches.  This exposed employees to a 20 foot fall hazard into the water.
