29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) On or about 4/24/15 at a roofing project located at 27-28 Martingale Court, East Aurora, New York; employees were using a ladder jack scaffold, with the scaffold brackets and platform to the outside of the supporting ladders. The employees accessed the platform by climbing the supporting ladders and climbing around the bracket and platform.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 4/24/15 at a roofing project located at 27-28 Martingale Court, East Aurora, New York; employees were using a ladder jack scaffold to perform work and access the roof. The platform height was approximately 10 feet and there was no personal fall arrest system in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 4/24/15 at a roofing project located at 27-28 Martingale Court, East Aurora, New York; employees were placing shingles on a roof with a 10 in 12 pitch and an eave height of approximately 18 feet and a porch roof with a 5 in 12 pitch with and eave height of approximately 10 feet. There were no fall protection systems in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) On or about 4/24/15 at a roofing project located at 27-28 Martingale Court, East Aurora, New York; employees were accessing the roof of a house using extension ladders that had there side rails approximately 18 inches above the landing surface.    NO ABATEMENT CERTIFICATION REQUIRED
