29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.    a. On or about April 29, 2015, in the workplace, employees required to paint were provided half mask respirators to use.  The employer did not ensure that the employees were medically evaluated before being fit tested or provided the use of the respirators in the workplace.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a.   On or about April 29, 2015, in the work area,  the employer did not provide a guard to protect employees from coming in contact with ingoing nip points on the ENCO horizontal-vertical sanding machine. Employees were exposed to fractures and lacerations.  b.  On or about April 29, 2015, the employer did not provide a guard to protect employees from coming in contact with unused portion of the blade on the Well Saw horizontal band saw. Employees were exposed to fractures and lacerations.  c. On or about April  29, 2015,  the employer did not provide a guard to protect employees from coming in contact with the blade on the Press Master shear. Employees were exposed to lacerations and amputations.

29 CFR 1910.243(c)(4): Other portable grinders. The maximum angular exposure of the grinding wheel periphery and sides for safety guards used on other portable grinding machines shall not exceed 180 deg. and the top half of the wheel shall be enclosed at all times. (See Figures P-5 and P-6.)   a. On or about April 29, 2015, in the work area, the employees were required to use a Skill Redo hand held grinder that was missing a guard. Employees were exposed to injuries such as possible lacerations.     b.  On or about April 29, 2015, in the work area, the employees were required to use a Metabo hand held grinder that was missing a guard.  Employees were exposed to injuries such as possible lacerations.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.   a. On or about April 29, 2015, in the work area, the employees were not adequately trained in the hazards associated with chemicals such as, but not limited to, iron oxide, manganese and copper.
