OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    ERMC III Property Management Co. Inc. did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to crush hazards due to operating an aerial boom lift, which was not maintained in accordance the JLG Operators Manual or American National Standards Institute (ANSI)/Scaffold Industry Association, Inc. (SIA) A92.5-2006 . The Occupational Safety and Health Administration has not determined that the alleged violation caused a death or serious bodily harm to anyone.

29 CFR 1910.67(c)(2)(ii):     Only trained persons shall operate an aerial lift.    On 4/29/2015, ERMC III Property Management Company, LLC had not ensured that each person was competent to operate an aerial boom lift safely, as demonstrated by the successful completion of the training.  Two employees were operating JLG Boom-Supported Elevated Work Platform, Model E450AJ/Serial # 0300066578, without required training.    In the alternative:    OSH ACT of 1970 Section (5)(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the following hazard:     Two employees were operating JLG Boom-Supported Elevated Work Platform, Model E450AJ/Serial # 0300066578, without adequate training.      One method of abatement is to provide training in accordance with American National Standards Institute (ANSI)/Scaffold Industry Association, Inc. (SIA) A92.5-2006. 29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  On 4/29/2015, ERMC III Property Management Company, LLC had not ensured that employees used the types of PPE that would protect them from hazards identified by the employer.  The employees were required to park a JLG Boom-Supported Elevated Work Platform, Serial # 0300066578, underneath a ramp and near a steel beam, which was painted orange, on the fourth level of the parking garage.  The employees were not required to wear hard hats in areas where head injuries were possible such as the lift parking area.
