The employer did not provide the laborer employee with information and training regarding the health hazards associated with noise exposure. The laborer employee was exposed to noise levels of approximately 100 dBA as an 8-hour TWA.

29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: a) On the Main Street Bridge of the 700 block in Neenah, WI, a laborer employee was exposed to noise at 428.9% (noise dose) of the allowable noise dose of 100% during a sample period of 480 minutes during one shift on 05/19/2015. An effective hearing conservation program consists of, but are not limited to, the following elements: 1) Monitoring of employee noise exposures 2) Properly fitting hearing protection with adequate noise attenuation 3) Employee training and education in noise hazards and protection measures 4) Baseline and annual audiometry 5) Recordkeeping
