OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards:  a. On or about May 14, 2015, on a semi-truck trailer, at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound sound barrier wall construction site, a strap which secured a 15,000 pound concrete sound wall panel to the trailer was removed by a subcontracted employee before the stability of the load was assured, which resulted in the panel falling from the trailer and fatally crushing the subcontracted employee.    b. On or about June 12, 2015, on a semi-truck trailer at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound, sound barrier wall construction site, chains and binders which secured three 15,000 pound concrete sound wall panels to the trailer were removed before the stability of the load for each individual panel was assured and exposed employees who worked on, or within, the falling reach of the panels to crushing hazards.

29 CFR 1926.704(d): Lifting hardware for precast concrete members was not capable of supporting at least five times the maximum intended load applied or transmitted to the lifting hardware:  a. On or about May 14, 2015, at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound, sound barrier wall construction site, a crane rigged spreader bar with a maximum load rating of 32,000 pounds was used to lift 15,000 pound pre-cast concrete sound wall barrier panels and was not capable of supporting at least five times the maximum intended load of 75,000 pounds and exposed employees to struck-by and crushed-by hazards.  b. On or about June 12, 2015, at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound, sound barrier wall construction site, a crane rigged spreader bar with a maximum load rating of 32,000 pounds was used to lift 15,000 pound pre-cast concrete sound wall barrier panels and was not capable of supporting at least five times the maximum intended load of 75,000 pounds and exposed employees to struck-by and crushed-by hazards.
