29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a)Duffys Outdoor Power Equipment, 2482 Patterson Road, Grand Junction, CO: On and prior to May 8th, 2015, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l). Employees operate the Clark brand propane powered industrial truck to move equipment/parts during the course of their work. This condition exposed employees to struck-by hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a)Duffys Outdoor Power Equipment, 2482 Patterson Road, Grand Junction, CO: On and before May 8, 2015, the employer did not develop and implement a written hazard communication program. Chemical products used by employees include but are not limited to gasoline, motor oil, brake cleaner, carburetor cleaner, and various solvents while performing maintenance and repair of small engines. Abatement Note: All written Hazard Communication Programs must include the following elements: 1)A list of the hazardous chemicals known to be present in the workplace; 2)Labels and/or other forms of warning secured to containers into which hazardous chemicals were transferred; 3)Safety data sheets (SDS) for each hazardous chemical utilized in the workplace; and 4)Provide employees with effective information and training on hazardous chemicals in their work area on initial assignment and whenever a new physical or health hazards is about to be introduced.

29 CFR 1910.1200(h)(1): The employer did not ensure employees were provided with effective information and training regarding hazardous chemicals in the workplace at the time of their initial assignment and, whenever a new product or chemical was introduced into the work place: (a)Duffys Outdoor Power Equipment, 2482 Patterson Road, Grand Junction, CO: On and before May 8, 2015, the employer did not provide employees with information and training regarding chemical products used in the workplace. Chemical products include but are not limited to gasoline, motor oil, brake cleaner, carburetor cleaner, and various solvents. Abatement Note: The employer shall ensure that employees are informed of the following: 1)Any operations in their work area where hazardous chemicals are present; and 2)The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets. Abatement Note: The employer shall ensure that employees are trained on the following items: 1)Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area; 2)The physical and health hazards of the chemicals in their work area; 3)The measures they can take to protect themselves from hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as work practices, emergency procedures, and personal protective equipment to be used; and 4)The details of the hazard communication program developed by the employer, including an explanation of the labeling system and the safety data sheets (SDS), and how employees can obtain and use the appropriate hazard information.
