29 CFR 1910.120(q)(1):  An emergency response plan was not developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, are exempt from the requirements of this paragraph if they provide an emergency action plan in accordance with 29 CFR 1910.38.   a) On or about or prior thereto June 10, 2015, in warehouse storage area of LSIdaho, Inc.:  The employer had not developed a written emergency response plan to account for potential spills of herbicides and pesticides in the warehouse.   The employer uses a Toyota powered industrial truck (PIT) to move pallets of material in the warehouse, and a potential scenario for a spill is if a fork were to puncture a container, drum or tote.   Examples of hazardous chemicals stored in the warehouse include:  Aquasweep, a corrosive; DMA 4 IVM, a combustible liquid and vapor;  and Vapona, listed as a poison.   Abatement certification is required for this item.
