29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     The employer does not protect employees engaged in residential roofing operations  6 feet (1.8 m) or more above lower levels. As a result, the employer is exposing employees to the hazard of falling.  The lack of fall protection was most recently observed on June 13th, 2015 at the jobsite of a new construction project located next to #9 Meadowbrooke Drive, Troy, IL. The employees conducting residential roofing operations are exposed to the hazard of falling approximately ten and one half (10.5) feet.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.    The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 845083, citation number 02, item number 1 and was affirmed as a final order on 11/26/2013, with respect to a workplace located at 1348 Frontage Road, O'Fallon, IL 62269  The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 714760, citation number 02, item number 1 and was affirmed as a final order on 05/06/2013, with respect to a workplace located at 208 Oakshire East, Glen Carbon, IL 62034   The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 313016032, citation number 02, item number 1 and was affirmed as a final order on 11/02/2010, with respect to a workplace located at 917 Pacific Crossing Drive, O Fallon, IL 62234   The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 313016016, citation number 02, item number 1 and was affirmed as a final order on 11/02/2010, with respect to a workplace located at 420 Chadwyck Drive, O Fallon, IL 62234   The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 313015224, citation number 02, item number 1 and was affirmed as a final order on 11/02/2010, with respect to a workplace located at 7044 Milburn Estates Drive, O Fallon, IL 62269

29 CFR 1926.1053(b)(1): Portable ladders are used for access to an upper landing surface and the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:     The employer uses portable ladders that fail to extend three (3) feet or more above the upper landing surface to which the ladder is being used to gain access.  As a result, the employer is exposing employees to the hazard of falling.  This fall hazard was most recently observed on June 13th, 2015 at the jobsite of a new construction project located next to #9 Meadowbrooke Drive, Troy, IL.  Employees performing residential construction are exposed to falling approximately ten and one half (10.5) feet while using an extension ladder to ascend/descend to the roof.
