29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard of being struck by a powered industrial truck.    (a) Warehouse:  Ceva Logistics did not select and provide the appropriate personal protective equipment to protect employees from struck by hazards as the provided high visibility suspenders were not adequate and did not provide as much visibility as high visibility reflective vests. On or about June 24, 2015, an incident occurred where an employee wearing pink high visibility suspenders was struck by a moving forklift, when walking toward the employee Break Room.

29 CFR 1910.178(n)(4): Industrial truck driver(s) were not required to slow down and sound the horn at cross aisles and wherever vision was obstructed:    (a) Warehouse:  Forklift operators were not required to slow down and sound the horn where the pedestrian crossway to the Break Room is located.  On or about June 24,2015, an employee was struck by a moving forklift which did not slow down and sound the horn at the pedestrian crossway by the Break Room and Main Office.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):    (a)  Warehouse:  Employees were exposed to the Hyster 80 # 2329 forklift which was missing the clasp to latch the propane tank and the forklift was not taken out of service.
