29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a. On or about July 16, 2015, at the above addressed jobsite, an employee was operating a powered industrial vehicle (Pettibone) during material handling operations. The operator of the powered industrial truck did not complete the required training and evaluation specified in paragraph (l).

On or about July 16, 2015, at the above addressed jobsite, employees on an aerial lift (Genie, S-60) were not wearing a body belt or full body harness. The employees were thereby exposed to the hazards associated with a fall of approximately ten (10) feet.
