29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Route 206 & Omni Drive, Hillsborough, NJ 08844: Employer failed to provide a competent person in trenching and excavations while employees engaged in the installation of a retaining wall were exposed to cave-in hazards while working in an excavation greater than 5 feet deep. Condition observed on or about July 16, 2015.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): a) Route 206 & Omni Drive, Hillsborough, NJ 08844: Employees engaged in installation of a retaining wall were exposed to cave-in hazards while working where one side of the excavation was greater than 5 feet deep, without a protective system and/or benching of soil. Condition observed on or about July 16, 2015.
