This violation was observed on or about August 27, 2015, at the site where an employee was exposed to a fall hazard of approximately 9 feet in height to the unpaved ground level below, when standing on a chain being used as a guard rail on a field designed platform elevated by a JLG Telehandler (Model: 6042, SN:0160048449) rough-terrain forklift while installing plywood to a commercial building.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section: Construction site, East side: The employer does not ensure that scaffolds are designed by a qualified person and are constructed and loaded in accordance with that design. This violation was observed on or about August 27, 2015, at the site where an employee was exposed to a fall hazard of approximately 9 feet in height to the unpaved ground level below, when using a makeshift scaffold platform that lacked a mid rail and had a top rail with more than 3 inches of deflection, while being elevated with a JLG Telehandler (Model: 6042, SN: 0160048449) to installing plywood to a commercial building. Longhorn Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(a)(6), which was contained in OSHA inspection number 1044202, citation number 1, item number 1 and was affirmed as a final order on May 19, 2015, with respect to a workplace located at 20015 Eagle Ford Way, San Antonio, TX 78221.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform is not attached to the fork or the fork-lift is moved horizontally while the platform is occupied: Construction site, East side: The employer does not ensure that scaffold platforms supported by a fork-lift are attached to the fork or that the fork-lift was not moved horizontally while the platform is occupied. This violation was observed on or about August 27, 2015, at the site where an employee was exposed to a fall hazard of approximately 9 feet in height to the unpaved ground level below, when using a field designed personnel platform elevated by a JLG Telehandler (Model: 6042, SN: 0160048449) forklift, and was secured to the mast with nylon ropes tied in a knot. Longhorn Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(c)(2)(V), which was contained in OSHA inspection number 314306671, citation number 1, item number 2 and was affirmed as a final order on May 11, 2011, with respect to a workplace located at 19876 I-35 S, Lytle, TX 78052.

This violation was observed on or about August 27, 2015, employee(s) were exposed to a fall hazard of approximately 9 feet to the unpaved ground below while on a field designed personnel platform without: a fall arrest system, a mid rail installed, and a top rail that deflected more than 3 inches, that was elevated by a JLG Telehandler (Model: 6042, SN: 0160048449) rough-terrain forklift. Longhorn Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1044202, citation number 1, item number 3 and was affirmed as a final order on May 19, 2015, with respect to a workplace located at 20015 Eagle Ford Way, San Antonio, TX 78221.
