29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard:  a)  On or about August 31, 2015, the employer failed to ensure that guardrails were in place on the open sides of the Ajax  Upsetter #2008. Employees are required to work from the top of the upsetter. Falls to the levels below were measured as 62" on the north side, and 105" on the south side.   b) On or about August 31, 2015, the employer failed to ensure that guardrails were in place on the open sides of National Upsetter #2006. Employees are required to work from the top of the upsetter. Falls to the level below on both sides were measured as 62".
