29 CFR 1926.451(c)(2)(v):  The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:   The employer is failing to protect employees from fall hazards associated with working off of a mobile scaffold platform that is not adequately secured to the forklift while building a new residential home.  The most recent occurrence of this was found on a new residential construction located at 20915 William St., Elkhorn, NE where the employer has employees working off of a platform held higher than 10 above the ground by resting on the forks of an all-terrain forklift without securing the platform in a matter that would prevent the platform from sliding off the forks.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    The employer is failing to protect employees from fall hazards associated with working off of a mobile scaffold platform without guardrails while building a new residential home.  The most recent occurrence of this was found on a new residential construction located at 20915 William St., Elkhorn, NE where the employer has employees working off of a platform held higher than 10 above the ground by an all-terrain forklift without the use of either personal fall arrest systems or guardrails.

29 CFR 1926.454(a):    The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:                                                                                                          The employer is failing to train employees to recognize all hazards associated with working off of a mobile scaffold platform while building a new residential home.  The most recent occurrence of this was found on a new residential construction located at 20915 William St., Elkhorn, NE where the employer has untrained employees working off of a platform held higher than 10 above the ground while resting on the forks of the all-terrain forklift.  Instances include but are not limited to:   a.     On the day of the inspection an employee using the platform to work at elevated heights without having installed the guardrails or donning personal fall arrest.   b.    On the day of the inspection an employee using the platform to work at elevated heights without securing the platform to the forklift mast in a manner that would prevent the platform from sliding off the forks   c.     In the days prior to the inspection untrained employees using the platform to work at elevated heights over 10 feet.
