29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Guadalupe Moreno Construction at 13918 Weld County Road 4, Brighton, CO: On and preceding 9/2/15, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Workers performed repairs to roof trusses and roof sheathing of a barn. Workers used extension ladders to access the trusses. The workers were exposed to fall hazards while working among the trusses and when using the ladders. Guadalupe Moreno Construction did not perform inspections of the worksite and equipment. This condition exposed the workers to an approximate sixteen foot fall hazard.

The workers were not protected by a guardrail system, safety net system, or personal fall arrest system. Guadalupe Moreno Construction did not ensure that the workers utilized fall protection. This condition exposed the workers to an approximate sixteen foot fall hazard. Guadalupe Moreno Construction was previously cited for a violation of this Occupational Safety and Health Administration Standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection 98979, Citation 1, Item 1 and was issued on September 23, 2011, and affirmed as a final order on October 18, 2011, with respect to a workplace located at 2472 Wolf Creek Drive, Brighton, CO 80601.

On 9/2/15 an employee of Guadalupe Moreno Construction fell approximately ten feet from a Werner aluminum extension ladder onto a concrete floor. The employee died as a result of his injuries on 9/2/15. The employer did not report the work related fatality to OSHA.
