OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    Ohoopee Tap (Line 374041) - On or about September 15, 2015 and times prior to:    a) An employee was exposed to a crushed-by hazard while standing and/or sitting near the boom on a Jarraff All-Terrain Tree Trimmer (Telescopic Boom Saw, S/N: WH492J0781).    b) The employer did not ensure that employees were adequately trained to operate the Jarraff boom saw (S/N: WH492J0781), thus exposing employees to various operational hazards such as struck-by, crushed-by, electrical, and trip and fall hazards.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:  a) Ohoopee Tap (Line 374041) - On or about September 15, 2015, the employer did not report a hospitalization within 24 hours of the incident involving an employee who sustained serious injuries after being crushed by the boom of a telescopic boom saw.
