On or about 7/30/15, at Hudson Buffet-100 West Acre Business Center, Fishkill, NY 12524. Employee was admitted at Westchester Medical Center and hospitalized until discharged on 8/6/15. Employee sustained chemical burns to the face, right upper extremity, and right lower leg. The employer failed to report to OSHA a work-related inpatient hospitalization of one or more employees.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a). On or about 10/7/15, on site, for the employee that handles lye to clean the filters above the stove. The employee last handled the lye 2 weeks ago; adding a 12-16 oz. of lye into a bucket of water. Lye is Sodium Hydroxide, which is caustic. According to the NIOSH Pocket Guide to Chemical Hazards, adding water to Sodium Hydroxide causes a violent reaction. The employer did not assess the workplace to provide and require the use of a face shield and rubber apron. b). On or about 7/30/15, on site, for the employee that sustained chemical burns to the face, right upper extremity, and right lower leg from adding lye to the dishwasher drain. The employer did not assess the workplace to provide and require the use of a face shield and rubber apron.
