29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     A.)  Landfried Paving, Inc. - On or about 10/1/15, and at times prior thereto, the employees did not receive specific training on excavation hazards.  The excavation training did not cover items including, but not limited to, excavation hazards, soil typing, when cave in protection systems/methods needed to be utilized, the depth required for the use of cave in protection, the contents of 29 CFR 1926 Subpart P, and when not to enter an unprotected excavation.  Employees were performing work operations in excavations that were approximately 7 feet deep.  Work operations included, but were not limited to, shoveling dirt and rock out of the excavation.

Landfried Paving, Inc. - On or about 10/1/15, and at times prior thereto, employees were working in a 7 ft. deep excavation without a ladder or other adequate mean egress from the excavation.

Landfried Paving, Inc. - On or about 10/1/15, employees entered and worked in unprotected excavations.  Excavations were at least 7 ft. deep.   Employees were in the excavation performing work operations that included, but were not limited to, shoveling dirt and rocks.      B.)  Landfried Paving, Inc. - On or about 9/28/15, employees entered and worked in unprotected excavations.  Excavations were at least 7 ft. deep.   Employees were in the excavation performing work operations that included, but were not limited to, troubleshooting objects impeding the backhoe, removing old footers, determining how to set basins, and shoveling dirt/rocks.
