29 CFR 1926.251(a)(6): Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:    (a) Excavation, north side of Zaxby's Restaurant located at 2205 Cobb Parkway, Smyrna, GA 30080: Employee was exposed to struck-by hazards while working in close proximity to the Airman (Model - PDS185S) trailer compressor being lowered into the excavation by the excavator operator which had a rigging system that included a hook, shackle, and synthetic sling that was ripped, torn, and tied into a knot. The competent person on site failed to inspect the sling and remove the sling from service before exposing the employee in the trench guiding the equipment into the excavation.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) Excavation, north side of Zaxby's Restaurant located at 2205 Cobb Parkway, Smyrna, GA 30080: An employee air testing the new sewer lines inside an excavation  which measured approximately 200-feet long by 6-feet wide by 14-feet deep was not provided with a safe means of egress, i.e. ladder, steps, and or ramp.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CF 1926.652(b)(1)(I) in that the excavation was sloped at an angle steeper than one and one half horizontal to one vertical (34 degrees measured from the horizontal).    (a) Excavation, north side of Zaxby's Restaurant located at2205 Cobb Parkway, Smyrna, GA 30080: Employee was exposed to cave-in hazards while working in an excavation which was approximately 14-feet deep by 6-feet wide at the bottom of the excavation with no adequate cave-in protection system in place. The employer did not ensure that the wall of the excavation was protected, sloped or shored to prevent exposure of collapse.    Dickinson Plumbing & Sewer Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.652(a)(1), which was contained in OSHA inspection number 316079227, citation 1, item 1 and was affirmed as a final order on 05/02/2015 with respect to a workplace located at 705 Dixie Street, Carrollton, GA 30117.

29 CFR 1926.602(a)(9)(i): Bidirectional machine(s) were not equipped with an operable horn, distinguishable from the surrounding noise level, which could be operated as needed when the machine is moving in either direction:  (a) Lot adjacent to Zaxby's Restaurant located at 2205 Cobb parkway, Smyrna, GA 30080: The Caterpillar 953C Crawler Loader was operating in an areas in close proximity to employees and other equipment without an back-up alarm or operable horn while the machine was moving in different directions. Employees located in these areas were exposed to potential struck-by hazards.
