29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:         (a) New York Congregational Nursing Center Inc.,  At the time of the inspection the employer's Exposure Control Plan did not have documents indicating the solicitation of inputs from non-managerial employees on the evaluation and selection of engineering controls such as, but not limited to, Ulticare Insulin Safety Syringe. The condition was noted on or about October 22, 2015.           NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

29 CFR 1910.1030(f)(4)(ii)(A): The employer did not ensure that the health care professional evaluating an employee after an exposure incident was provided with a copy of this regulation:        (a) New York Congregational Nursing Center.  Health care provider reported exposure incident as a result of trying to pull the retractable barrel over the insulin needle.  At the time of the opening conference the employer did not have documentation indicating that they had provided the health care professional with a copy of the Bloodborne pathogens standard. The condition was noted on or about October 22, 2015.         NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY  DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT  CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS  VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

Health care provider reported exposure incident as a result of trying to pull the retractable barrel over the insulin needle.  The employer did not provide the health care professional with documentation and or medical records of the employee to show the required vaccinations. The condition was noted on or about October 22, 2015.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
