29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner: On or about October 28, 2015 at the job site, where employees were exposed to a fall hazard of more than 10 feet while installing fascia on a gas pump's canopy from a mobile scaffold that did not have several wheels locked.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. On or about October 28, 2015 at the job site, where employees were exposed to a fall hazard when using a metal extension ladder that had a broken rung.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about October 28, 2015 at the job site, where employees were exposed to a fall hazard of more than 10 feet when installing clips onto a gas station's canopy from a scaffold without a ladder. Hugo Soriano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(e)(1), which was contained in OSHA inspection number 467599, citation number 1, item number 2 and was affirmed as a final order on 08/27/2012, with respect to a workplace located at the corner of Hwy 30 and Westridge Ave, Huntsville, TX 77320.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about October 28, 2015, at the worksite where employees were exposed to a fall hazard of more than 10 feet when installing clips onto a gas station's canopy from a mobile scaffold without a complete guardrail system. Hugo Soriano was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926. 451(g)(4)(i) , which was contained in OSHA inspection number 467599, citation number 1, item number 3 and was affirmed as a final order on 08-27-2012, with respect to a workplace located at the corner of HWY 30 and Westridge Ave, Huntsville, TX 77320.
