This continuing violation was most recently observed on November 2, 2015, when portable fire extinguishers were not provided on site for employees where flammable liquids were in use for refueling a gas powered compressor. The employer's ongoing obligation is to ensure that the appropriate number of fire extinguishers are placed within the worksite based upon the anticipated fire hazard and the worksite's physical layout.

This continuing violation was most recently observed on November 2, 2015, when employees framing the three story structure worked and walked in close proximity to a hole in the floor of approximately 2 feet by 4 feet that was used as access to an upper working level. The employer's ongoing obligation is to ensure that any floor holes are protected to prevent workers from falling to a lower level.

This continuing violation was most recently observed on November 2, 2015, when the top step of a stepladder was being used by an employee to access a third floor work area, exposing them to a fall hazard greater than 10 feet. The employer's ongoing obligation is to ensure that the top step of a stepladder is not being used as a working surface. This continuing violation was most recently observed on November 2, 2015, when hazards including, but not limited to, fall hazards and fire hazards were observed, but the employer failed to ensure employees were provided proper and adequate equipment such as ladders and fire extinguishers to use as a means of controlling these hazards. The employer's ongoing obligation is to ensure that frequent and regular inspections of the job site are conducted as part of a safety and health management system. This continuing violation was most recently observed on or about November 2, 2015, when an employee was observed unloading material hoisted by a forklift at an unprotected edge on the second floor without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. b) Construction site, American House, 3rd Floor, Perkasie PA - The employer does not ensure that appropriate fall protection equipment or methods are in use. This continuing violation was most recently observed on or about November 2, 2015, when an employee was erecting missing sections of guard rail along the unprotected edge was not protected from falling by any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. c) Construction site, American House, Center Stairwell, Perkasie PA - The employer does not ensure that appropriate fall protection equipment or methods are in use. This continuing violation was most recently observed on or about October 30, 2015, when an employee was installing fire sheathing and caulking, but was not protected from falling by any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard.
