29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. a. On the North end of the tubular welded frame scaffold where sub-contractor employees were laying block, the scaffold did not have a guardrail thereby exposing employees to a 12 foot 6 inch fall hazard. b. On the South end of the tubular welded frame scaffold where sub-contractor employees laid block, the scaffold did not have a guardrail thereby exposing employees to a 14 foot fall hazard.

29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable: a. On the site where work was performed from tubular welded frame scaffold, the Superintendent was not trained in the requirements of the scaffold standard and the proper way to inspect scaffold thereby exposing employees to a fall hazard.
