On or about November 24, 2015, the employer had not included asbestos in the hazard communication program to comply with the hazard communication standard �1910.1200.  Asbestos Containing Material was found in the boiler room pipe insulation.

29 CFR 1910.1001(j)(4)(iv): At the entrance to mechanical rooms/areas in which employees reasonably can be expected to enter and which contain ACM and/or PACM, the building owner did not post signs which identified the material present, its location, and appropriate work practices which, if followed, will ensure that ACM and/or PACM will not be disturbed.     On or about November 24, 2015, the employer had not posted signs to identify the areas in the boiler room where pipe insulation contained asbestos.

Employers and building and facility owners did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.    On or about November 24, 2015, the employer had not determined the presence, location, and quantity of Asbestos Containing Material (ACM) or Potential Asbestos Containing Material (PACM.)  Hard white pipe insulation in the boiler room was determined to contain Chrysotile Asbestos.

29 CFR 1910.1001(j)(7)(iv): The employer did not provide, at no cost to employees who perform housekeeping operations in an area which contains asbestos containing material(ACM) or potential asbestos containing material( PAC, an asbestos awareness training course, which shall at a minimum contain the following elements: health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes. Each such employee was not so trained at least once a year.    On or about November 24, 2015, the employer had not provided an asbestos awareness training to employees who performed housekeeping operations in areas that contained ACM or PACM in the boiler room.
