29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  (a) Marquis Bey DBA Tuff Guy Construction and Remodeling on or about January 15, 2016, at the address of 422 E. Lake St. Toledo, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

Lake St. Toledo, OH: The employer failed to ensure employees were protected from falls while installing new roofing material to a residential type structure.  Employees operating in this condition were exposed up to a 15 ft. falls to the ground below.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  a) Marquis Bey DBA Tuff Guy Construction and Remodeling on or about January 15, 2016, at the address of 422 E. Lake St. Toledo, OH: The employer did not ensure employees were wearing appropriate eye protection such as, safety glasses while using a pneumatic nail gun to fasten roofing material. The employees using these tools were exposed to potential eye injuries from flying objects.
